No employee of a school district or an institution under the control of the Board of Regents or the South Dakota Board of Technical Education [...] may without the written permission of the student's parent or guardian knowingly and intentionally address an unemancipated minor student by: (1) A name other than the student's legal name or a derivative thereof; or (2) A student's preferred personal title or pronoun that is inconsistent with the student's sex. For the purposes of this section and sections 2 and 3 of this Act, the term "sex" means the classification of a person as either female or male based on the organization of the body for a specific reproductive role, as indicated by an individual's sex chromosomes, naturally occurring sex hormones, and internal and external genitalia present at birth.
A school counselor, or another school staff member, must notify a student's parent or guardian: [...] If questions regarding any of the following topics are discussed with a student during a direct counseling service: (a) Gender; (b) Gender confusion; (c) Gender dysphoria; (d) Homosexuality; or (e) Transsexuality.
No law enforcement agency of this state or of any political subdivision thereof may: [...] (1) Engage in a diversity, equity, or inclusion program; [...] (5) Enter into or renew a contract with any entity or organization that promotes or participates in a diversity, equity, or inclusion program; [...] (9) Adopt, implement, or promote any theory of unconscious or implicit bias, cultural appropriation, allyship, transgenderism, [...] social justice, intersectionality, neopronouns, inclusive language, gender identity or theory
A student who does not meet the definition of a female may not enter a changing room, restroom, or shower room designated exclusively for females. A student who does not meet the definition of a male may not enter a changing room, restroom, or shower room designated exclusively for males.
An Act to require that birth certificates and certain official documents reflect biological sex.
A flag representing a political viewpoint, including gender [...] or sexual orientation may not be displayed on public property.
WHEREAS, when the framers proclaimed in the Declaration of Independence that "all men are created equal" and "endowed by their Creator with certain unalienable Rights," they referred to a vision of mankind in which all humans are created in the image of God and therefore of inherent worth; and WHEREAS, Obergefell undermines this vision by declaring that citizens must seek dignity from the state.
